Court to review visitation rights following same-sex divorce

Annapolis, Md. (AP) — Maryland's top court has agreed to decide whether a transgender man has parental rights to visitation or custody of a child whom his former partner gave birth to before the couple married.

The Daily Record of Baltimore reports that the Maryland Court of Appeals says it will review lower-court decisions that Michael Conover lacks parental standing and thus has no right to visitation or custody of the child, 5-year-old Jaxon Conover.

Conover is a transgender man. He identified as a woman when he married the boy's biological mother, Brittany Conover.

The boy was born six months before the couple married and 17 months before they divorced.

In August, the Court of Special Appeals upheld a Washington County Circuit judge's ruling that the plaintiff was a "third party," not a second parent.
