South Dakota to join transgender bathroom challenge

Pierre, S.D. (AP) — Attorney General Marty Jackley says South Dakota is joining other states in challenging the Obama administration's directive to public schools to let transgender students use bathrooms and locker rooms matching their gender identity.

Jackley said Tuesday that the issue should be handled at the state and local level. He says the directive is a "one size fits all solution" that exceeds the president's constitutional authority.

The federal guidance says public schools must treat transgender students in a way that matches their gender identity, even if their education records or identity documents indicate a different gender.

Gov. Dennis Daugaard vetoed a bill this year approved by the Legislature that would have required transgender students to use bathrooms and locker rooms matching their sex at birth.
