Suspended Ala. chief justice wants new justices for appeal

Montgomery, Ala. (AP) — Suspended Alabama Chief Justice Roy Moore wants four sitting Supreme Court justices to recuse themselves as he appeals his suspension from the bench over a gay marriage order.

The motion filed Monday also seeks to prohibit three former justices from hearing his appeal.

Six of the judges sat on Moore's unsuccessful challenge to the Judicial Inquiry Commission's actions in bringing charges of judicial ethics violations against him.

A judicial ethics panel suspended Moore after ruling he urged probate judges to deft clear law that gays and lesbians can marry. Moore in January told judges that a state order to refuse marriage licenses to gay couples remained in effect.

Moore is appealing his removal to the Alabama Supreme Court.

Moore is also seeking the recusal of Justice Greg Shaw.
